These provisos experts recommend that you stay far away – Aftenposten

What if they find out that the ten year old bathroom did not have membrane, what is the result? You must pay a rejection of several hundred thousand kroner after the sale, or you have to pay for a new bathroom?

Some commandments followed by subject. The conditions can be anything from time of acquisition and subject to financing, to reserve the right to leave with the lamp in the hallway. These are the brokers strangest examples of prejudice.

– Disclaimers are no simple affair. My specific advice to sellers is that one should not accept the modification, says Carsten Pihl, consumer adviser for residential trade with Association of Real Estate.

He believes subject to takeover and occupation are fair as long as they are date fixed – and fits with the plans you have.

How do you actually deal with prejudice on everything from takeover to the membrane in the bathroom? We asked Thomas Bartholdsen Consumer Council, Nils ABOUT Nordvik Nordvik in & amp; Partners and Robert owned by AS Borgå in Ihus.

1. Subject to funding

Bidders bid conditional upon the person concerned receives a loan.

Nils ABOUT Nordvik, senior broker and partner in Nordvik & amp; Partners: – I am very wary of letting the seller accept bids subject to funding. If the bidder has applied for loans, but received no response from the bank, I would not accept the bid. If the bidder has received a verbal yes from the bank, but is waiting for the written, and the bank can confirm, then one can be any safer. If bidder number two does not have prejudice and lies 20,000 million under’d chosen the bid without modification.

Robert owned by AS Borgå, broker and partner in Ihus: – It is important that the financing is in order. Before the bid is accepted we do everything we can to confirm funding. We are required to submit a bid. It is highly unlikely that you say yes.

Thomas Bartholdsen, Director of the Consumer Council: – There will be an assessment in the individual case. How much higher is the bid? Is bidder credible? What we do know is that the agencies very gladly recommends not to accept bids subject. They often try to get the bidder to remove its reservation.

2. Subject to takeover

Bidders bid subject to a certain date as takeover.

Bartholdsen: – It is a relatively frequently used subject, and consequences by accepting bids with such a reservation is very transparent.

Nordvik: – It is important to investigate when people want to take over, and it looks the budskjemaet. Once a bid is accepted, one must clarify the time of acquisition. Koster property 15 million, and you have to wait half a year on your money, then current rates.

owned by AS Borgå: – Sometimes one gets bids subject to specific completion date. Then you have to see if this fits with what is practicable for selling before eventually accept the offer.

Expert tips: This should check the view

3. Subject to constructional conditions

Bidders bid proviso that the bathroom has a membrane, that the basement is completely dry or such that the roof leaks.

Nordvik: – There is dangerous to accept subject to constructional conditions. Say that you have moved into the apartment where you do not know the circumstances. Bidder reserves the heavy technical stuff you have no idea. What if they find out that the ten year old bathroom did not have membrane, what is the result? You must pay a rejection of several hundred thousand kroner after the sale, or you have to pay for a new bathroom?

Bartholdsen: – If you are selling is very confident that the foundations are in good condition so you can of course accept an offer subject that there is no need for extensive work in the foundation. As a seller, you assume greater responsibility in that you endorse that specific thing is in order. It becomes a matter of how comfortable you are with risk, and how confident you are that the property is in good condition.

owned by AS Borgå: – It depends on what caveat applies. Any such reservations may be difficult to decide and some clarified quickly. We must have a clear dialogue with the bidder and clarify what caveat applies so that the merchant can decide it.

4. All data with inventory

Bidders bid subject to the chandelier, couch or washing machine with the purchase.

Nordvik: – It is absolutely okay, but you must remember to specify that things are not new and that it is not certain that they are guaranteed. Perhaps the stove or refrigerator is ten years old and smokes in the takeover, it is important to include in the agreement that you can not guarantee for technical condition.

Bartholdsen: – It is a subject that is easy to relate to. If the dining room is a arveklenodie, it is perhaps difficult to say yes to. Lighting that fits very well and that may not fit so well elsewhere, the seller may be happy not to have to take with them on.

owned by AS Borgå: – Here it is better to be clear about what is not included in the inventory prospect, so there will be no uncertainty in the aftermath. We go through what sells wants to take with him and what is permanent fixed during the preparation of the prospectus.

5. Subject to sale of residential

Bidders bid without prejudice to their current residence is sold at a certain price.

owned by AS Borgå: – Such prejudice can be difficult for a seller to decide. We assess the object, giving the seller and bidder feedback if there is an easily marketable object and provides guidance acc. situation. It is often such prejudice is removed when we get given bidder enough information that such a reservation can not be accepted by the seller. This is usually fully understandable for a bidder.

Nordvik: – It’s hopeless. Especially if one sets a selling price. If it is not set a price, then it is almost regarded as non-subject, for a sale may be on a dime. Seller can say that caveat is not acceptable, nor suggest further overtagelsestid so buying time to sell.

Bartholdsen: – This is a subject that is difficult to deal with. My impression is that it is used more often in rural areas.
